The parties shall appoint as sole arbitrator a retired judge who presided in the Commonwealth of Massachusetts. All decisions of the arbitrator shall be final and binding on both parties and enforceable in any court of competent jurisdiction. Notwithstanding the foregoing, the Pelham Historical Society shall be entitled to seek injunctive relief, security, or other equitable remedies from the United States District Court for the District of Massachusetts or any other court of competent jurisdiction.

If any part of these terms is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of the remaining provisions. The Pelham Historical Society (the "Society" or "We") of Pelham Massachusetts may collect the following type of information from about you ("the user"):

Clear gifs/web beacons information:

Who can see User Content: Any User Content that you voluntarily disclose for posting to our Services becomes available to the public and cannot be removed, except by Pelhamhistory.org or Pelhamhs.org in its sole discretion. Once posted on our Services, User Content may not be removable from public view, as copies may remain viewable in cached and archived pages of our Services, on other sites that have republished us, or if other Users have copied or saved that information. If you do not wish your User Content to be available to the public, please don't post it on our Services. Your username and if you choose to disclose it, your real name, will be published publicly. Once published your username and / or real name may not be able to be removed.

Who can see your IP address: If you post User Content on our Services while not logged in, your IP address will be published with your User Content in order to attribute your contribution to our Services. A selection of Trusted Users with administrative powers on our Services have the ability to review IP addresses of users to reduce abusive behavior. Any third party service embedded on our Services such as an advertiser, video provider, social network or other third party will also have access to your IP address.

Who can see your email address: If you enter an email address, you will enable communication from our Services and other Users. If you reply to users or participate in group activities such as meetups, your email address will be shared with these users. In addition, some email addresses such as blocked@pelhamhistory.org forward to a group of Trusted Users, who will use your email address to reply to the email.


What happens in the event of a change of control:
The Pelham Historical Society and its Services are a local non-profit historical society. As such, in the event of the dissolution of the Society, Your information such as customer names and email addresses, User Content and other user information related to our Services may be among the items sold or otherwise transferred in these types of transactions. We may also sell, assign or otherwise transfer such information in the course of corporate divestitures, mergers, acquisitions, bankruptcies, dissolutions, reorganizations, liquidations, similar transactions or proceedings involving all or a portion of the company.

We currently do NOT serve advertisements on any of our Services. This policy may change without notice.

We may allow third-party ad servers or ad networks to serve advertisements on our Services.
